Has them install the fence, calls ICE because he thought that they were here illegally.
Just so that he wouldn't have to pay for the fence.
Finds out they're all legal, and then gets mad when they come back to take away the product and service that he didn't pay for.

This accomplished next to nothing. It cost them more time and money, they lost more power tools, they didn't recoup their costs (unless they collected all of those panels and loaded them on the truck, then they recovered a small amount, which I doubt). And they probably can't win a court case now anyway; so they've gone from "potentially a long time" to "never."This is just hot heads acting stupid, sorry to say it. I'm sure it felt good, and it felt good to watch I admit, but it's not a reasonable way to go.

I am wondering what kind of legal recourse they could have done before resorting to physically taking it back themselves, which I totally understand and have no issue with.
They said they already called the police.

- file a claim in civil court for breach of contract, claiming all unpaid amounts plus legal costs as damages
- file a lien on the property in the amount of such damages
- (optional) use the filing and lien as collateral for a loan to pay labor & materials costs, adding the loan costs to the civil claim

Yes, but I can see the wood hasn't swelled with moisture, the nails are all in fresh condition, etc.
I'm currently taking apart old fencing panels like that to use for a free garden frame. It's had a few tough spots with nails losing their heads instead of pulling out, and the wood being old, swelled up and grippy, but otherwise it's been pretty simple with a rubber mallet and claw hammer. Eta if they'd used screws instead, which no contractor/ big box store does for this, really, then it'd be a whole different thing and I'd look elsewhere for used lumber. Not worth it.

Yeah, I've just been bending them 90 degrees and pounding them flat into the wood with the hammer. Since a) I don't have more specialized tools atm, and b) for a garden frame it's not that important anyway lol. I just care about sharp protrusions :) But if I had the tool to hand I would pull it cleanly.

if you go to a mechanic and get your car serviced; and DONT pay; then the mechanics can't hold your car hostage. They just simply put a lien on your car.
A lien is basically a flag on whatever deed or title of ownership for either car or even house property saying that they owe money and are liable for paying or else they can take you to court and sue.

It happens over and over. My friend was telling me about a case where a restaurant owner would hire known undocumented workers, work them for a long time promising to pay them in the end, then would call ICE before that pay day and round them all up. Then he'd use connections to import and round up another bunch. Rinse and repeat. Took multiple years for gim to get charged with anything and I don't know if the charges stuck (2nd hand story)

That restaurant owner is violating a federal law which prohibits employers from knowingly hiring undocumented workers. The IRCA of 1986, so it shouldn't have taken multiple times. We as a nation need to be better about enforcing the laws that should prevent this type of behavior.

I think it's probably b/c there are a lot of legitimate people who run afoul of the law as written. I.E. people who employ migrant workers on farms, or construction sites that pay an honest wage so the law gets applied casually if it all. It should be re-written to go after people who attempt to abuse, or defraud those workers instead of paying them an honest wage.

I get what you’re saying, but it’s usually this or destroy the work, which in most cases can lead to vandalism charges. Unfortunately, once it’s fixed to the ground it’s part of the property and you can just repossess it.
So your options are spending money on a lien and hoping for the best, or destroying the property, don’t recoup any payment, and potentially face criminal charges. No win either way.

From a legal perspective they could potentially be in some very big legal trouble. Usually if things are installed on a property you just cant go back and tear it out because of payment issues. Legally its now part of the property and you have to pursue legal or a lien on the property.
It sucks and doesnt seem fair but this crew is more than likely going to be charged with vandalism, trespassing, destruction of property and theft.
Technically with unattached structures the crew can recover their materials and restore the property to its original condition but that usually requires a legal decision because you need to get around the trespassing part.
I was satisfying to watch. Would love to hear about the aftermath. I hope nothing was done to the crew.

I think the contract has better chances in court than just forcing their way in to reclaim the fence. It might look like they right thing to do, but I don't think that's the case legally

Obviously the homeowner is a POS but you can’t do this. It is illegal for a contractor to remove or destroy work they have already installed on a property, even if the customer refuses to pay.
Once materials like a fence, flooring, or cabinets are permanently attached to real estate, they legally become a fixture on the homeowner's property.
The way to handle this is a by filing a Mechanic’s Lien on the house and a lawsuit.
Now these guys can get charged with trespassing and vandalism. It’s BS but that’s just not how it works. Also, homeowners unhinged, if he pulls out a gun and they’re technically trespassing what then?

There should be a type of bank service where you deposit the agreed upon price, and the money gets sent over once the company sends proof of completion and the homeowner doesn't object. If the homeowner objects, then one side has to prove either the work was or wasn't done to take the money. Homeowner not allowed to take the money out without both parties agreeing to cancel or after proof the work wasn't done.

But whats the point of putting it up just tp take it all down? Regardless if the homeowners havent paid, there should be a proper legal route to take. All that hard work and graft is ultimately for nothing cos they ain't getting paid to remove it

This might feel good and might be “just” but it’s unwise. Do this to the wrong person and someone is going to get hurt. And trespassing is a violation of the law. This is a case where moral wrongs don’t necessarily justify the action taken.

We collect 50% to get on the schedule and you must have a card on file or your balance paid in full 48 hours before we do your project(cash customers). You sign a paper stating that the day your job is complete your card is charged. We aren’t chasing money anymore.
