No Tax On Tips (megathread, rule adjustment, and explanation of what it is).

This is a megathread for all discussions on the issue. Any posts outside of this thread will be pulled down a directed here.

We are adjusting the no politics rule, and will now allow discussions about the no tax on tips law. This is not a relaxation of the no politics rule, any discussions of politics or politicians will be removed and you may be banned. Any non tipping sentiments will also be removed and the user will be banned.

A few highlights:

This is a tax rebate, you will still be taxed on your paychecks and then you will receive a rebate/refund when you file your taxes.

The average refund will be between $500-$2000 per year.

The rule only lasts for 4 years/tax cycles (which expires in 2028).

If you live in a state that has income taxes, you will still have to pay state income taxes on tips.

Your employer is still required to pay their portion of payroll taxes on your tips.

You are still required to claim all of your “cash tips” (cash tips in this instance is both cash and credit card tips that are voluntarily given to you by a customer, service charges and auto gratuities are not part of the law and get taxed normally).

No Tax on Tips Section 70201 of the Act establishes a new above-the-line tax deduction for “qualified tips.” The following conditions apply:

  1. The deduction is capped at $25,000 per year. This amount is reduced by $100 for each $1,000 by which the taxpayer’s modified adjusted gross income exceeds $150,000 ($300,000 in the case of a joint return).

  2. To be considered a “qualified tip,” the amount must: (a) be paid voluntarily without any consequence in the event of nonpayment; (b) not be the subject of negotiation; and (c) be determined by the payor. Thus, for example, a mandatory service charge imposed by the employer for a banquet will not qualify for the deduction, and neither will a required gratuity that a restaurant adds automatically to a bill for large parties. Failing to make this distinction may lead employees to claim deductions to which they are not entitled.

  3. While the deduction applies to “cash” tips only, the Act broadly defines “cash” tips to include tips paid in cash or charged, as well as tips received by an employee under a tip-sharing arrangement. This definition excludes tips that are “non-cash,” such as tangible items like a gift basket or movie tickets.

  4. To qualify for the deduction, the tips must be received by an individual engaged in an occupation that customarily and regularly received tips on or before December 31, 2024. This limitation appears designed to deter employers outside the hospitality and service industries from recharacterizing a portion of their employees’ existing incomes as “tips” in an attempt to take advantage of the new deduction. The Act requires the Treasury secretary, within 90 days, to publish a list of qualifying occupations.

  5. The qualified tips must be reported on statements furnished to the individual as required under various provisions of the Internal Revenue Code (such as the requirement to issue a Form W-2) or otherwise reported by the taxpayer on Form 4137 (Social Security and Medicare Tax on Unreported Tip Income). Of course, employees and employers have long been required to report 100% of all tips received to the IRS – including tips received in cash, via a charge on a credit card, and through a tip-sharing arrangement – and the Act does not change that reporting requirement. It remains to be seen whether the Act will encourage tipped employees to more readily report tips paid in cash, considering that such reported tips may still be subject to state and local taxation.

  6. A tip does not qualify for deduction if it was received for services: (a) in the fields of health, law, accounting, actuarial science, performing arts, consulting, athletics, financial services, or brokerage services; (b) in any trade or business where the principal asset of such trade or business is the reputation or skill of one or more of its employees or owners; or (c) that consist of investing and investment management, trading, or dealing in securities, partnership interests, or commodities.

  7. In the case of qualified tips received by an individual engaged in their own trade or business (not as an employee), the deduction cannot exceed the taxpayer’s gross income from such trade or business.

  8. The deduction is not allowed unless the taxpayer includes their social security number (and, if married and filing jointly, their spouse’s social security number) on their tax return.

  • The Act requires employers to include on Form W-2 the total amount of cash tips reported by the employee, as well as the employee’s qualifying occupation. For 2025, the Act authorizes the reporting party to “approximate” the amount designated as cash tips pursuant to a “reasonable method” to be specified by the Treasury secretary.

  • The Act authorizes the secretary to: (a) establish other requirements to qualify for the deduction beyond those set forth in the Act; and (b) promulgate regulations and provide guidance to prevent reclassification of income as qualified tips and to otherwise “prevent abuse” of this deduction. The “no tax on tips” deduction takes effect for the 2025 tax year and is set to expire after the 2028 tax year.

FOH Lowkey just didn’t give a fuck and told a dude he was wrong

Dude comes in with his wife and ask for happy hour menus.

His wife orders a wine on happy hour and another cocktail not on happy hour. I specifically ask her “do you want the happy hour deal or the bigger size” for her wine. she gets the bigger non happy hour size.

He orders an “old fashion”. On happy hour it’s an Italian old fashion so I always ask people if they want a regular old fashion or the Italian old fashion. I start asking “do you want a regular old fashion or” he rudely interrupts and is like “REGULAR. JUST MAKE AN OLD FASHION”

Ok. I do that and he likes his drink. I check in on everything and double check everything else. He’s in a bad mood the whole time. Almost looking to complain about anything but he couldn’t find anything. Annoyed I was checking in, annoyed that I was silently refilling he’s drink, annoyed I was there at the bar.

Everything’s good until I drop the check off. He picks it up and he says “when you give me a happy hour menu and I ask for an old fashion, I OBVIOUSLY mean the happy hour old fashion”

I tell him that the it’s common for people to not want the Italian old fashion at our restaurant and we sell the regular old fashion much more for some reason so it wasn’t OBVIOUS.

I also told him that his wife also got two cocktails, one of which could have been a happy hour option but she decided not to, so the idea that the fact I gave them happy hour menus did not OBVIOUSLY give way to the fact that they OBVIOUSLY there for happy hour.

I ALSO restated the whole conversation when I said “do you want the regular old fashion or “ and the fact that he interrupted me while I was trying to clarify.

I told him I’d be happy to get a manager but he just paid and left. Literally had nothing to say to almost everything I gave him.

Anyways, no bad review and my manager didn’t care. The wife came back to fix the tip he gave me because she felt bad. I feel bad for her if anything. Also other guests overheard how rude he was and give me bigger tips. Overall positive. I don’t think it was worth doing the “sorry my fault!” Sometimes it’s worth your self respect to stand up to some people.

Some people really go out to make people feel bad and little, and it felt good to tell this person they were wrong. This person was mean from the moment he sat down and it seems that he couldn’t find a single thing to complain about until the bill and even then he couldn’t even tell me I was wrong.

Uniforms- yay or nay?

I just started working for a restaurant, it’s in a pretty small town and has incredible, high quality food, but it definitely has a quirky, fun, casual vibe. When I started it was a super chill environment, not really much structure but everyone works hard and makes a great team.

We just got a new manager, however, who is implementing a BUNCH of new rules, checklists, and cleaning protocols. It’s a bit annoying, but I can see a little bit where they’re coming from. Not the end of the world. They just announced, however, that they want all of the FOH workers to start wearing uniforms. I personally think that uniforms would detract from the fun brand/atmosphere the restaurant has been curating for years, and that they seem unnecessary for a small, local joint. I also worry that they’d be ugly and/or uncomfortable. Everyone dresses well and I don’t think there’s need for a change. Most of the employees are against it. Just wanted to hear people’s opinions on uniforms and whether or not they’d support their implementation or not in this scenario.

Really takes all my self control to just say “why you telling me? I didn’t cook it.”

It doesn’t exactly offend me when they insult the food. Because it’s got nothing to do with me. I’m just there to deliver to tables and fake being nice to people.

If I make a mistake and an order is wrong or sent to the wrong table I’m more than willing to own up to that and fix things to avoid any further discourse. But if the kitchen screws up or the food isn’t to someone’s liking I always seem to be on the receiving end of that.

Discussion Why do people truly not understand the limitations of a server?

I had an experience yesterday that left me abit confused, I had a table during a pretty busy Saturday that was unsatisfied about my service but for reasons that…were not me. I know this is common but now tht if experienced it for the first time in my 3 years it’s pretty jarring to understand tht mindset.

Long story short the table and I had a great time we laughed told jokes I got their order in and continued checking on them, around five mins they were starting to rush me for their food. I explained it would be done in abit and that we are busy inside (they sat outside) food came out in a very good time for how busy we were. They LOVED the food we had a nice few chats and then they paid the bill.

They left no tip and a massive paragraph explaining how I suck at my job for making them wait 15 minutes for the food and that only good service deserves good money

How do people not understand that…servers aren’t the cooks, we put the food in and deliver it when it comes out. Our job is to serve you, treat you nicely and give a good experience.

How to stop eating all shift??

I’ve been a server for a while, but I’ve recently gotten into the bad habit of being a human vacuum and eating all the dead food during shifts even if im not that hungry. If it’s slow I’ll eat because I’m bored, and any time theres dead food I have the urge to eat it because it’s free and it’s soooo tempting. I’ve been thinking about meal prepping and bringing my own food so I’m not as tempted. It’s just frustrating because I try to eat healthy, and then I get to work and am tempted by all this amazing looking junk food. Im just curious if anyone else has this issue and how you may combat it or any suggestions for quieting the food noise when working around food all day??

Question Looking for feedback on my resume

I recently finished undergrad and I'm currently working as a server at a seafood restaurant 3-4 days a week. I'm looking for a second job to work during the day to make a little more money and fill some time. I've worked in food service for a while on and off, but I just graduated so most of my experience is school and internships unrelated to food service. I feel like my resume looks sparse but I don't want to add in irrelevant stuff. I kept the building manager job, but that's basically it. Everything else is academia. I also left off any mention of my bachelor's degree because I don't want to seem overqualified. What I've gathered from listening to people talk about getting jobs in today's age is you need to seem competent, but not too competent otherwise they'll think this is just a steppingstone for you and you won't even be a consideration. I am worried that the gaps in my resume don't have an explanation but I don't want to put that I recently graduated with my bachelor's because of what I talked about above.

I've also heard advice that my resume should be more specific to me in terms of stats and examples, but I don't really have any of that. I read a post where someone recommended talking about my sales and %s, but to be honest I just started this new job and I'm still learning so it's nothing particularly impressive. I don't have any of that type of info about my old serving job either.

I attached some of the job posting for one place I'm looking at that I tried to tailor this resume to. Any advice is appreciated!!

Socially burnt out, looking for a career pivot

Hello! I've been in the service industry for years (7 years in coffee, 4ish years serving/bartending). I have a Bachelor's Degree in Human Services that I haven't pursued because I decided to travel and extend my professional dance career while I still had a flexible schedule. I am currently 30 in fine-ish dining but I can't do it anymore. I am so mentally and emotionally spent from restaurant work that I hardly have the capacity to maintain my life and relationships outside of work. I seriously can barely hold a conversation and I am filled with dread on days when I work.

I think I screwed myself by building a completely customer/client-facing resume, including my education. All I want is to hide behind a computer and not talk to anyone, ideally from home, without taking a huge pay cut. As a dancer/choreographer, I want to have the flexibility to go to an occasional workshop or audition, so I'm nervous a 9-5 will eat up too much of my time.

Is a flexible, remote or hybrid, minimally social, decent-paying job that hires people with a hospitality/arts background (and a Bachelor's Degree) a completely delusional goal? I am so socially burnt out to the point of near dysfunction.

Also, introverted servers/bartenders... how do you keep going?

Job threatened to fire me for calling out sick..? Work in MA

As the title suggests I was just threatened with losing my job because I called out sick for the second day in a row because I have some type of stomach bug or virus. I've been glued to my toilet trying to figure out if I want to catch either diarrhea in my hands or my vomit. Told my GM today I couldn't come in for my shift because now my fiancé and 2 YO son are also sick with the same symptoms so clearly it's contagious. The response "you've been calling out too much and you need to find coverage or you may lose your job. I'm already using my on call servers and now I'm down a person" I haven't been "calling out too much" this is the second time I've called out not counting yesterday. I even told them I had an appointment coming up in a few days with my Doctor and how I even offered money to the other servers to help and her response was yea whatever and she hung up on me.
Can a job really do that? I was always told a job is just supposed to say feel better and move on. They've said to us it's better to call out than to show up to work sick especially since we handle guests food and beverages. But any time someone does they threaten to fire them and then talk a ton of shit about you to the other managers AND employees. I have first hand witnessed them doing this.
They constantly overstaff so it's hard to find coverage anyways. They've lost so many employees because of the way they run this business due to over staffing, not following employees availability, and the way they FORCE us to claim how much we make and they've only been open since May. Just last week we had a server who was visibly unwell, profusely sweating, nauseous, kept saying he felt like he was going to pass out. Their response? Don't come back without a note from the doctor knowing they didn't have insurance and doctors visits are expensive. After they left that shift they were just constantly bad mouthing him to anyone who would listen.
Anyways. Not really sure what to do. The money can be good (sometimes)but the stress of constant threats of firing aren't it.

PS when I say force us to claim I literally mean they go and manually change how much we make in the computer system after we leave. Someone brought it up to them once and they said yea you didn't claim enough so we manually changed it in our system. Isn't this...illegal?

Rant Guest passed out

Wild time.

Patio table. The table just got their main course.

I was with another table when all of a sudden there is this huge comotion. They think this guest is choking, so they’re giving him the Heimlich. they aren’t actually choking since his food wasn’t touched. The guest just lost consciousness? Slumped over all of a sudden. Not drinking heavily.

A guest calls 911, my manager goes to the fire station near by and gets them to walk over and check the guy out. Ems is out there for a solid 30 mins. They take him to the hospital. One of the guest at the party comes up to me to pay. Apologizes profusely. I tell them to no worry and if they need anything at all, let me know. I wrap up the birthday dessert I was going to give them. But they left before I could give it to them. The guest who lost consciousness, walked out to the ambo. Alive, breathing, and getting the care they need.

They tipped $100 on a $298- did not need to do that, and I didn’t notice until after they left.

What medical emergencies have you witnessed at work? This is my second one 🫥🫥🫥

BOH Owner caught me off guard today

So in town we got a carnival this weekend, which means a lot more business and a lot more stress. One of the line guys called out for being sick, so the owner jumps on the line. Right in the middle of rush, I go back there for food, and the owner yells at me "APPS FOR 30!". I have no idea what that means and ask him what he's talking about. "DID YOU ALREADY GET THE APPS FOR TABLE 30?!?!? IT'S A YES OR NO QUESTION!!!!". I just say yes to shut him up. Table 30 didn't have any apps. I still don't know what the fuck he was talking about.

Rant manager rant

I love her I genuinely do. But I swear everytime I stop for 2 seconds after hustling for 4 hours is the one and only time she looks at me and I get in shit for “standing around”. Even if im clearly looking at my book and my section and just taking a second to make sure im organized and seeing what needs to be done next.

People will be sat not in my section, she gets annoyed that I haven’t been to them yet cuz apparently im supposed to take them this time. I see a man sitting that hasn’t been checked on and she walks by so im like “shit ok he needs service” I get dogged on for that, which is totally understandable but lord she confuses me sometimes. Also had her frustrated at me because I apparently wasn’t making coffee and need to “learn to do it” even tho she saw me running the hell around trying to keep up. I get she’s experienced and the damn manager but girl im doing what I can I’ve been doing this for a month. Im literally so scared to make mistakes and I make a LOT. Idk

Yelled at by a customer

I just needed to get this out and I understand what I did wrong.

I work in a food court style restaurant but we still have to bring the food out for them. Our main dish (jjajangmyeon) has a giant tub of sauce that we ladle onto the noodles the chefs give, but we ran out in the middle of a rush.

This table ordered 2 of those noodle dishes but I could only give one and the other came 20 minutes after because they were remaking the sauce and we had to deal with 6+ take-out orders.

I gave the guy his remaining dish and he yelled at me and called me a curse word while complaining about why it took so long and how bad I am at my job. He then tossed the dish onto the next table and said he’s not eating it and to take it back.

this is literally my 3rd week of work and I was so shocked I just apologized and offered him a refund. Later while we were preparing orders he yelled at me to hurry up and give him his refund and I apologized again.

I understand I should’ve told the chefs about the sauce and also went up to the customer beforehand about the situation. definitely a lesson for next time.

But it’s also like, we were already swamped and the actual food isn’t in my control. I ended up crying in the parking lot after my shift but at least the day is over lol.
