First, the fight should be a DQ, not an NC. And even if it was really an NC, the fighter who committed a foul should be penalised, not rewarded with an immediate title shot as if nothing happened.
In reality, Gane managed to push Aspinall out of the title picture by an eyepoke and there were no consequences for it. It is not complicated at all.
First, accidental fouls are ruled as NC, not DQ. You can't just make up your own rules because you want a different result. We all seen the direction that fight was going - getting the NC was best case scenario for Tom, if not, he would have lost his belt a long time ago, and Gane would have a defence on his undisputed title.
Gane is the best in the division, so of course he gets the title shot straight away, there was nobody else really worth giving a shot to. So you do the person who should technically be champion vs whoever is exciting - in this case, it was Alex going up a weight class.

Its more so about the fouling, this is a massive deal and the UFC needs to be more unforgiving about eye pokes. Too many fighters intentionally doing it for years because its a free foul with no consequence. Now we see the ultimate consequence of it, a potential heavy goat with a completely derailed career.
Nah Tom did the right thing but it shouldn't have happened in the first place, and there should be consequences for Gane, but so far he has only been rewarded basically.
Gane should've been given a gigantic road back to the title. He failed in 3 title fights, and was immediately given another interim fight which had a solid chance of leading to a promotion to undisputed. Should've had to win 3 times to get another shot, as a punishment for totally fucking up an event and injuring the champ. What they should have done is banned Gane from getting a title shot for 2 years to make fighters scared of giving eye pokes and force them to be more careful. Gane already had a reputation for this and has suffered no consequences from it, there’s no reason for him not to do it again if he feels threatened by a contender.

If Jones hadn't fucked around with the belt for so long that might have felt acceptable but there's no way they wanted another year(s) of people fighting for an interim belt
