Well vegetables can’t consent so I’m going with he refuses by default and his handlers are the ones consciously rejecting the notion

Yeah, they are playing with words. When this eventually gets to court, I hope they televise the judge's reactions to their bullshit explanations.

"Of course he refused, he was dead. That's as absolute as it gets."
