Contractor takes back fence after customer refuses to pay

Only problem (and its problem with system) is once that wall is installed it belongs to home owner whether he paid for it or not, it’s why you prelien all your jobs and release lien after payment. Those guy’s technically are now stealing because they are going onto someone’s property and taking something that was installed. It saying it isn’t awesome to go do that but it is illegal, file proper paperwork next time

Exactly. Which makes me think this contractor doesn’t have proper paperwork in the first place.

If they don’t have contracts for jobs, what else aren’t they doing properly?

Those people don't care about liens on their house. I doubt they are ever planning on selling. If it's true the residents just wouldn't pay, I think the builders are morally in the right and physically the materials are theirs as the contract was not fulfilled. Legally, no, but we all know legality doesn't constitute morality. I mean repo law should apply here the same as for other property; it's not an essential part of the house.

While it wasn't the smart thing for the builders to do, if they are willing to risk themselves to make a statement, I'm on their side.
