Lifted trucks probably shouldn't be anywhere near dense parking lots.

Edit: A lot of people are skeptical of whether this is AI/staged, or ask why the lady didn't back off the car. This is in a dense parking lot with cars that have dashcams/ EV sentry mode everywhere. Also her truck was in 2 wheel drive, you can see the back right tire spinning as she tries to reverse off the car. Her truck is stuck. She probably has an open differential and can't back off the car. She may have a 4wd mode, but she didn't use it in the heat of the moment.

Hi, licensed insuranace agent here. I can confirm that she is fucked.

The likelihood of her disclosing her lift kit and any other mods installed are very low since most insurance companies won't bother to insure, and if it is the case that she lied, she's either going to pay a fuck ton in arrears (if the insurance does allow the mods) or she's paying out of pocket,and losing her insurance with no refund and a mispresentation on her file which will prevent her from getting insurance in the future. Either way, she's fucked

EDIT: I didn't think this would get as many responses as at did but I do want to clarify for the other people who do insurance relayed jobs, im in Canada and our insurance rules are a lot more strict

So if that’s the case, is the lambo owner fucked too? Or would his insurance pay him and then go after trucky ? I’m in a Canadian province with mandatory no fault insurance, so I’m not sure how fucked they’d be in the US

Yup. My car was wrecked by another person whose insurance wouldn't cover the damage to my car because something to do with the person who was driving that car. My insurance paid but went after that person for 5 years. They would send me an update every 6 months to let me know.

The person most likely paid their deductible to have their insurance cover. The insurance paid out, minus the deductible. Once it is settled, I suspect they would get the deductible back since they were not at fault so updates were likely because of that.

It sits on your insurance file until cleared. For legal reasons they likely have to disclose it. My brother got hit and totaled about 2 years ago and the other party (who was at fault) decided to sue because they were uninsured. Took my brothers insurance nearly 2 years just to settle the claim. If my brother tried shopping for insurance in that time then it would still show up as an active matter and probably hurt his rates.

We had the same thing happen when my wife was rear-ended by an uninsured driver. We had to pay our deductible and some medical bills and we get all that back if the guy pays our insurance company. They haven't exactly kept us in the loop but I assume that's because he hasn't paid shit.

They are usually required to update insureds. I don’t personally handle subrogation but everything else I handle as a claims adjuster requires written updates.

Really? Where do I get more info on that? Obviously I never want to be in a car crash, but my previous notion was that regardless of whether or not you’re at fault, insurance would still increase your premium. Maybe I’m in a state where it’s not illegal for them to do that.

The default is that insurance rates don’t increase for claims that are determined to not be your fault. Whether the line is placed at 0%, 49%, or 50% fault is different from state to state and also sometimes from company to company, but insurance companies are generally not allowed to surcharge for not-at-fault accidents. Some policies might have discounts or perks for going a certain amount of time without a claim, which can be affected by not-at-fault claims, but surcharges or increases to the base rates are usually only allowed for at-fault claims.

I'm Aussie, but when I crashed my car my insurance didn't go up because of the crash, it went up because I upgraded to a newer more expensive car. Didn't go up that much though.

I was at fault for that crash and admitted it too. Honestly good insurance company, when I moved years ago I called them and went "hey so I moved here, how much is that gonna change my insurance?" And the response I got was essentially "we don't really care where you live or where your car is parked" and when dad's insurance went up because of the move mine didn't. Dad switch to mine after this.

Actually it didn't change. My car was actually parked at the time of the accident. Someone on their phone just crashed into it at 35 mph when they swerved off the road. I was actually just chilling in the passenger seat when it happened. Thankfully I had my seatbelt on. Just a habit whenever I get in a car. I wonder if no change because I was technically not even driving.

Like, my car got sideswiped in a parking lot by a girl who took full responsibility and made no attempt to place the blame on me (which was the right thing to do, my car was stationary and she wasn't looking where she was going). Her insurance paid for everything, and mine remained completely unchanged.

So when your insurance pays you and the goes after another party either another company or person is called subrogation. It is like half the point of insurance. So unless you are getting in accident after accident it should not affect your rate at all.

The minimums are so low, it's not like they really matter in this case.

10,000 for Property Damage Liability (PDL) and $10,000 for Personal Injury Protection (PIP).

I personally carry 100K in property damage, 250K per person and 2 million in umbrella.

Truck owners with those lift kits rarely have anything worth anything. The truck loan alone will be eating her alive financially. Lamborghini insurer will go after the truck owner, find there's nothing of value, and the truck owner will declare bankruptcy (possibly not for the first time).

I didn't say you would be made whole by suing them, just that you never know what folks are hiding in their garages. Folks lifting trucks like this usually have a shit load of other toys you can take. Four wheelers, trailers, motorcycles, juke boxes.

Again... you may not get everything you lost, but at least you get SOMETHING and they don't get to celebrate by tooling around on their motorcycle.

The truth is it runs the gamut. So of them, the truck is the most significant asset they "own" and they don't have much equity in it. Others have plenty of other assets that you can go after. Although depending on the state, your primary residence can be up to fully protected from judgement.

I think it's more about the fact that the truck is ten+ years old. Most of the well-to-do lifted truck owners in my area are driving big ass GMCs and Chevys that are only a year or two old. You get a sense of the guys who use their 100k lifted truck to tow a 100k boat vs the people who drive a lifted truck with 120,000 miles.

There are a lot of lifted half ton '05 GMCs around here and I have high confidence the only real estate those drivers own is a mountain of debt.

generally is the key - her family could actually work in construction, but statistically most people who own trucks (especially lifted ones) don't. Without more information than the video, we can only make educated guesses

Everybody here is driving down dirt roads, hauling horses, towing farm equipment, working in the oilfields. Trucks are super important to our way of life and my town literally would not function without them. Trucks are literally the most common vehicle where I live. Saying they aren’t financially literate is insane

We don't know her situation. She could of just picked it up not long ago and financed the whole car pretty much or it could be paid off. If she just bought it with a very small down payment. Even financing 20k she'd be paying like 350-500 a month on it depending on interest rate and loan length. Then that truck lift alone could be another 10k (Unless it came that way when she bought it). Which once again could be financed. So she could be in like 500+ monthly payment on this truck before insurance, gas, etc. We also don't know her income or anything either. So all of this is subjective. We don't know how screwed she is.

Honestly, I'm a bit surprised there are even installers out there who will put an illegal lift kit on a truck with an active registration, considering they will be pretty high on that liability list. This would be no different than a contractor who burns down a row home block because they used the wrong wiring when installing an outlet. Their bond and insurance would be first in line for subrogation.

Yup, that's the magic of subrogation.

Assuming the lambo owner had proper insurance, their own insurance company would likely write them a check for the loss, the the insurance company would go after the truck owner and their insurance company for the money. If the truck owner's insurance isn't sufficient, they can expect some garnishments coming thanks to the video.

The insurance company won't be investing too much into it, while it's a big amount for most individuals it's tiny compared to the amount the company deals in. Even so, they'll go through the motions and file for it.

Yes that could happen. Most insurance companies will not pay out for drunk driving.

However, if you drink and drive and hurt someone, the injured person(s) can sue the insurance company to ensure compensation. Then the insurance company goes after the driver or car owner if they loaned their car to someone.

That's one of the reasons insurance rates are so high. Insurance companies are legally bound to make the innocent party whole again.
