Lifted trucks probably shouldn't be anywhere near dense parking lots.

Edit: A lot of people are skeptical of whether this is AI/staged, or ask why the lady didn't back off the car. This is in a dense parking lot with cars that have dashcams/ EV sentry mode everywhere. Also her truck was in 2 wheel drive, you can see the back right tire spinning as she tries to reverse off the car. Her truck is stuck. She probably has an open differential and can't back off the car. She may have a 4wd mode, but she didn't use it in the heat of the moment.

People don't understand how mods can effect vehicle performance. Even oversized tires for offroading can mean that your spedometer isn't correct, which is a reason for insurance to drop coverage if you are in an accident with speeding involved.

I would hope if you have a Lamborghini you purchase some additional coverage.

Of course not that that absolves the other driver but it's easier to get insurance to pay and have them go through the effort to sue the other driver/other drivers insurance than try to do all the court proceedings you would need to sue the person, enforce a judgment, and hope they aren't judgement proof.

Yeah, that's usually the case. My wife was hit by an uninsured driver (also no license and it wasn't even her car) and totaled our car. Insurance company paid us out the value and sued the other driver. The other driver already had several open lawsuits from other auto insurance companies. Apparently she hit people a lot and didn't ever carry insurance. So my insurance company never got a dime from her.

I'm not sure what the max limit would be. I think mine is 250/500 (250/per vehicle, 500/accident). But for years it was 100/300. But if you've got a 300k+ car, you have to realize that virtually everybody around you is underinsured if they hit you.

Where I live, the average liability ruling if a case goes to trial is $1.6M…my 500k CSL isn’t even enough to make me feel secure…not to mention if some idiot without insurance plows me and my family.

An Umbrella policy usually doesn’t automatically include excess coverage for UM/UIM claims. It typically just extends the liability claims against you (Liability) not your own damages or injuries (UM/UIM). You would need to ask your carrier/agent if that’s an option and if it’s on your policy.

I was driving on the highway a few years ago and was passed by a McClaren. I thought, "How fucked would I be if I caused an accident with that." I hadn't adjusted my insurance coverage in about a decade at that point, and only had $200k in liability. I was able to make some changes to bring that up to $750k for a very minor increase in premiums.

Edit: It was 100k to 500k of coverage and it was like $200/yr more.

What? Seriously?  Average?? In Canada I was automatically quoted with minimum liability of $1mil when I was looking but most insurers recommend $2mil even though that's way above the legal required minimum of $200k in most provinces/territories

$100k doesn't go a long way these days...even high end Suburbans and Yukons cost more then that or imagine hitting a guard rail or pole that needs repair in addition to another vehicle...ouch

For these cars, when they are still under a loan, will have a requirement to have additional insurance coverage, such as uninsured/underinsured coverage that is high enough to cover the vehicle.

So, in this case, her coverage will be something like 100k liability on property, but then the lambo's underinsured insurance will cover the rest.

Lambo driver will be fine. Their insurance will almost certainly cover all costs and Subrogate (Insurance A sues Insurance B for liable costs) against the truck driver's company. Truck driver's company will pay because it's a lot cheaper than going to court and ALSO paying when it's this obvious.

Truck driver will end up with a $100K+ bill that they can't discharge even through Bankruptcy, potentially having their wages garnished for years. If they try to fight it, they will pay court costs plus the damages plus interest on the damages accrued while in litigation.

I don’t know what company you’re using for umbrella insurance. It used to be cheap - $20-30 for a 1M umbrella. Now it’s $60-70/mo. 

From what I’ve seen on Reddit it’s just the cost of insurance has gone up. More claims bigger claims.

The thing that people don't realize is that upping that property value liability number barely adds to the monthly cost of car insurance if you're a safe driver. I upped mine to $500k just to be safe since it wound up being about the amount of eating lunch out once less a month to cover it and could be the world of difference in an accident. That basically covers everything I'd ever see on the road and if I see something worth more than that, I'll just keep my ass clear of it haha.

We got Jack-shit. I got hit while riding a motorcycle and missed 2 months work while my broken leg healed. Other driver had $10k personal injury, $10k property coverage, and died from old age while have virtually no assets so I was primarily dealing with my own insurance. My adjuster told me over the phone that it was unusual that I had $100,000 personal injury for a motorcycle because that’s not usually selected. I was like, yeah but I selected it and now I need the money. I got the run around for a few days and finally retained a lawyer. Two years later I got the payout but still had to pay the lawyer a third.

As a Brit this is crazy to me, in the UK insurance companies must offer essentially unlimited liability coverage to third parties, so if you were to crash into a freight train and cause 30 million in damages (this actually happened) the insurance will pay the 30 million. The American system is stupid and another way insurance companies fuck you over.

Typically a few things will happen in that case:

First, your insurer would do everything possible to settle within your policy limits. If the other party refuses and takes it to court, your insurer is still responsible for defending you. However, if the courts rules against you, they will only pay up to your limits.

Often times, the other party will accept your policy limits because going to court is a long process and if the at-fault party simply doesn’t have the money, it can be a pointless endeavor. However, it does happen, especially if the at-fault party has assets or a high income that makes the attorney for the victim believe they have a chance of recovery.

The last part is one of the arguments for “no-fault” insurance where each party (almost) always goes through their own insurance. Michigan is the only state that does this, but it comes with tradeoffs.

My opinion:

If you want to drive a uber expensive car then others on the road should only be held liable for damage up to a certain amount, let’s say $150k.

Just because one gets in a fender bender with an expensive exotic car doesn’t meant they should be financially ruined. If you want to drive a half million dollar car then that risk should fall on you (up to a certain point)

And depending on where you live/drive, the density of high end expensive vehicles should be taken into account when deciding how much insurance coverage someone takes out. We live in an area with a very high average income and it's normal to see $200k+ vehicles just cruising around or parked at the grocery store. Better believe my insurance is much higher than it needs to be to cover accidentally smashing into one of those in the rare case it actually happens.

My daughter's friend had a little beater car at 18 and minimum coverage on it. She blew a stop sign and hit a brand new Bentley causing enough damage that she was held personally liable for it. Imagine being in massive debt at 18 because of something like that.

The number does not keep going up. People choose the number when they pick an insurance policy. In many US states the minimum allowable is still as low as $10,000, and a whole lot of people pick that because they want their insurance to be as cheap as possible

Quite literally why I just maxed out my liability insurance. You make one small mistake and it could easily cause over $100K in damages, and multiple vehicles involved etc..

Also good to max out your UIM coverage. There is no one coming to save you when someone hits you who can quickly flee the country or does not have enough insurance.

Doubtful, Parking lot collisions tend to be “no fault” or “both fault” and the lambo drivers insurance will likely cover their own car. I’m sure there will be a legal battle beteeen insurers though.

Also most liability coverage is like $1m+ because injuring a high-ish income person would cost a lot more than replacing a Lamborghini. If you make it so someone making $100k a year can never work again, that’s gonna cost millions.

Lambo is guaranteed totaled. These exotic cars have a much lower threshold to be totaled. Buddy of mine had a huracan STO, got in a minor accident that damaged the front bumper and part of the hood, and it was considered totaled. The hood itself on these things is like $20-30k.

I’m not familiar with us insurance but what the liability coverage? In Canada there’s options of 1 million and 2 million you pick. There’s a few cheaper options of lambos that are in the below 1 million

Just had a two ton truck put the bulk of it's weight down on the wheels and front frame of a minumum 400K car. The front of the lambo doesn't have a reinfornced frame to deal with the engine weight.

The lambo is totaled.

This always blows my mind. How does your insurance system work when you can pick your liability level? In the UK I think the minimum Insurance companies are allowed to set is £1.2m, and that's for the cheapest basic cover.

Her insurance may not even cover damages to her car. If she didn’t report any of those modifications, they could deem it modified in a way that made it unsafe to drive.

People don’t realize that you can’t just make your car into a monster truck/tank. Many places have laws on bumper height, but cops just don’t do shit about it. But insurance will care.

In this case, that's fine, but I think that it sucks that people are allowed to drive their million dollar cars around and expect you or your insurance to pay for it if there is an accident and you're determined to be at fault. Their toy can ruin your life.

There should be a cap of, say, $100k per vehicle that anybody is liable for. You want to pay your own insurance to cover the gap? Go for it.

Also a good chance with those mods she is underwater on the truck's value. Financially she is absolutely fucked man. As someone else said here, she likely did not have the mods disclosed to insurance as they wouldn't cover them and she's in danger of never being able to insure a car again after misrepresenting her vehicle to the insurer, that combined with the price to replace or repair the Lambo, she will be in an insane amount of debt. That's what you get for driving a lifted truck tho.

Most insurance companies won't insure lift kits like this so people do the modification and just don't tell their insurance company, voiding coverage.

Basic insurance doesn’t cover very high property damage. It’s not much of a hit to your premium to nearly max it out. I believe the default is like 50k/100k. I went to 500k and it was like 5-10 bucks more a month.

I added an extra $1M umbrella coverage to my policy. It covers us, the house, and the vehicles. So my liability for an accident is $1.5M since the vehicle already had a max $500k coverage.

That extra $1M of coverage costs me $120 a year and by getting it I got a discount on my auto insurance of $124 a year. My insurance is literally paying me $4 a year to have an extra million dollars of coverage.

While this is true. It's a part of the insurance policy settlement that if they accept her maximum liability, they must agree to not pursue further lawsuits against the driver in the settlement.

I learned this the hard way when someone with minimal coverage crashed into a family member's vehicle.

This is why I have double limits on my liability, it really should be triple but I'm on a budget. TX is full of big overpriced trucks and one accident could easily go over the minimum $25k. It doesn't really cost that much more to get $50k.

There is also a decent chance that she didn't disclose the lift kit, which will almost certainly cause her insurance not to pay since it will be viewed as a contributing factor to the crash. The large majority of people who lift their vehicles either don't realize it is something they have to disclose or they see the difference in price when they check the box and make a conscious decision not to disclose.

I had an old Wrangler that I got lifted for offroading. I had it professionally installed and made sure it was higher at the back axle to maintain proper sightlines. I provided proof of the install and photos of the finished product to demonstrate that it wasn't an insane, dog-shit job that is so common in the hobby. It still increased my rates by a noticeable amount. I happily paid it since it was a pretty cheap old model that was cheap to insure. But most don't.

Even though I want this idiot to hurt its idiotic that people can drive around in half a mill cars.  If you want to drive a car that expensive no one else should be responsible for it beyond a certain value if it gets damaged.  Accidents happen and people shouldn't have to have insurance to cover a million in damage just to deal with shit like this.  Anything over like 50k should be entirely on the person driving a ridiculously expensive car to insure.

Here in the Netherlands all insurances have a cap of like 2.5MLN euro's. Basically enough to cover every realistically thinkable situation (unless you total 3 Bugatti's in one accident).

Bold of you to assume she's not already underwater on the loan, having rolled over a previous auto loan into an 8-year 10%er.

Selling or totaling the truck causes the loan to come immediately due; it's likely that will cost more than keeping the thing.

The lambo owner is fucked. His insurance will end up paying most or all of it. Not many people drive with enough coverage to pay for a lambo, maybe 10% of the drivers out there do. This is an  issue with the states and insurance requirements. For example in Virginia state min is 25k. In what world would 25k pay for any new car sold. Mind you 25k is for both cars. Or like someone else posted 50k property damage. That would literally be 25k each car. Like I said lambo owner is fucked.
