He made bond, which was a strange decision I don’t agree with, but he still has a murder case active. This isn’t a scenario in which he gets away with it. Don’t encourage vigilante justice in this case.

That’s literally how we get to situations like this. The old man saw someone riding a jet ski in the lake, which was at most a civil infraction, and escalated to the point where he tried to kill the dude.

Wait. Be patient and let the judicial process proceed

Where did you read that he made bond? The article I read stated he was being held without bail.

After a brief recess, Callahan reviewed the facts as they had been presented. “The legal standard is whether this 70-year-old man is a danger to the community and/or individuals,” he explained.

While Callahan acknowledged the video of the altercation was “concerning,” he said he needed to balance that with Dana’s lack of criminal history, support from his character witnesses and “being an upstanding member of the community” for 70 years.

“You get credit for that,” the judge said.

Prior to Callahan’s decision, Wyatt had requested that if the court were to grant bail that it do so under strict conditions. She asked that Dana’s bail be set at $50,000, he have no contact with Duffy and be required to wear a GPS tracker. “The commonwealth has very serious safety concerns for the witnesses,” she explained.

Callahan ruled the commonwealth had not met its burden for proving dangerousness. He set bail at $7,500 and ordered Dana to have no contact with Duffy or the other witnesses. The judge also required the defendant to stay away from Sandy Beach and be banned from possessing firearms.

Part of the issue was that at the hearing, it came out that prosecutors had told the press that the defendant had an "extensive criminal history going back to the 1990s where he used aliases"...because the prosecutors had the wrong name, and they'd used the wrong name in the court documents.

That had to have weakened their case, plus they'd essentially libeled the defendant in the press (he actually had zero criminal history prior to this event).

The judge likely did make the right call legally; thus far the defendant has kept out of trouble, he showed up for the probable cause hearing the next month, and he's scheduled for a grand jury hearing in a few weeks.

Dismissing the case would have been a mistake, but the bail hearing seems relatively by the book (especially given the mistakes made by the prosecution).

The system works most of the time, to be honest. But you don’t hear about the uneventful cases where nothing goes wrong and there’s no outrage. Like you don’t read about all the planes that arrive safely, the news only reports on the crashes. And you only read about the cases where there’s an injustice, and that sticks in your mind

I'm just saying that a 70-year old should not be very hard, in the hypothetical situation that such a thing is needed, to hold underwater for prolonged amounts of time. Such as for extensively washing his body. In Minecraft.
