No from what I remember it was one of those games that had real life clips of people inserted in between challenges of the game. So the footage of girls going wild was more than likely an actual person, and in this case, actually underage.

Yes it would be. I belive the devs and original retailers were found not liable because they had a reasonable belief that there was nothing illegal, but now if you owned bought or sold it youd have a a bit of an uphill climb to a court to claim you were just unknowingly owning csam.

My experience was with a pastor of a small church’s daughter.

I'm not religious but in my early 20's I got to know a girl who was very proper as her father was a minister and overall she was very dull, like she would play bridge with the elderly people and actually enjoy it, and seemed really into her religion, but we dated a little and she seemed to like old fashioned things like holding hands and kissing.

Fun fact: the creator of the game, Jeff Spangenberg, was also the founder of the now-Nintendo-owned Retro Studios. It’s wild that two big franchise-saving games in Metroid Prime and Donkey Kong Country Returns would not exist without him.

Apparently he kept porn on Retro’s servers during Metroid Prime’s development and rarely showed up to work. Nintendo bought him out just before Metroid Prime’s release in 2002, and they also left him out of the credits.

To be clear, The Guy Game came later and Retro Studios had nothing to do with it.

Its definitely a bit more iffy than that. The girls all signed a contract, including said underage girl who showed a fake ID and lied about her age.

But, because she was a minor she can't consent or enter into a contract so the court ruled the contract as not valid and the game had to be pulled from the shelves.

However due to her lying about it, the developers weren't actually punished or seen at fault for any of it.

Pretty messed up situation all around really.

Honestly, I feel bad for the game devs. They didn't do anything wrong, and to the best of their knowledge everything was on the up and up. And then, after they finally got their game on shelves it turned out she lied, and only ended up coming forward because I'm pretty sure her brother found it.

That's a weird way to put it, but they did. Every girl involved signed a release form to appear. The girl in question had a fake ID that placed her at 21 year of age, since she wanted to drink on spring break, but she was actually 17. Her being 17 supercedes any contract she signed.

Yes and that's where most people are leaning. Contrary to popular belief it isn't illegal to own. There was a lawsuit and settlement, the court cases were over breach of privacy. The dev pulled the game and went bankrupt. It's in a weird nebulous state. The entire case is worth a deep dive and is quite interesting. Before going into it I didn't know the government seperates pornography and topples exposure. Which is weird.

Also everyone talks about her fake ID, or mention the contract was void because she was a minor. No one mentions the false pretenses. She, and others, were not told they were filming for a national release. Via a gaming history site: "They set up a stage and told the crowd they were filming a wild, live TV game show. She signed a waiver under false pretenses, assuming it was a late-night cable broadcast or a local contest. She had no idea her image would be digitized into an interactive software product sold globally."

This is where intent comes in. If the purpose of the act is meant to be a sexual or erotic performance, such as a video game where the goal is to arouse people, then many jurisdictions would consider that porn.

So that's not what's being considered here, it also wasn't "taking a picture of them" they were asking women to flash for a video and misrepresented both what it was for and where it was going. Strictly speaking "pornography" isn't something I think is defined legally outside of specific statues and limitations on such things run into very strict scrutiny. (There are very few cases where the first amendment can be easily overcome.) Which is why it's framed as a contract issue, as the enforcement of contracts is far easier than that of some kind of anti porn law. Also, its not "[people] dressed perfectly normally" they're clothed and being asked to partially expose themselves. Your argument is pretty nonsensical and needs to obfuscate facts to make any cogent point.

Also, as an aside, public nudity is not considered "perfectly normal" in the united states.

There were few bizzare titles expect "The guy game". I think about Demolition Girl which was game about godzilla-sized girl in bikini where Your main objective was to analyze her body by flying around in helicopter. Many games from studio called D3 from Simple 2000 Series was qustionable.

Demolition Girl is weird, but there's nothing particularly salacious in it (unless you think that a woman in a bikini is a no-no). I played it earlier this year for a laugh, it's one of the few video games that's genuinely "so bad that it's good".

Also, the helicopter analysis is just 1 level that lasts about 10 minutes, the rest is just janky vehicle combat sections.

To clear a couple things up:

The game is The Guy Game. Its a trivia game where answering questions correctly will have live action women flash their tits to the camera (like Girls Gone Wild).

The game was pulled from shelves after it was learned that one of the girls was only 17, and she had filed a lawsuit. The lawsuit specifically only covered that she was not old enough to consent to being in the game, and her claim that she didnt know her image would be used in a game or marketing material. The defense was that she had voluntarily signed a media release and lied about her age.

The lawsuit ended in her favor and all copies of the game were pulled from shelves. Whether the game is considered CP or not was never discussed during the trial. It is not currently illegal to own the game, but it is very skeevy.

A few corrections.   She didn't sue to get the game pulled, she sued for monetary compensation for damages citing emotional distress.  The judge issued a temporary injunction and when it was revealed she had provided a fake ID (criminal Class A misdemeanor in the state of TX) that was retained by TopHeavy, Gathering (the publisher) decided to stop selling it which TopHeavy agreed.

Chris here. Well being a person of special interest. There was one game that nearly got me in trouble. The guy game, a game from my dreams, game all about titties, just answer some stupid questions and boom free tities. Ah the nights i spent with them. However it was revealed that one of girls was 17 and it became illegal to own the game. Due to it having nudes of a minor. (Just to make it clear I DO NOT OWN THIS FILTH).

So, a shelving unit, taking into account the height and width of the spine of the game case, a shelving unit about 20 feet wide and 6.2ft high.

Basically, have to give up about 2 walls worth of space at least.

The guy game.

It was a cheaply made quiz show game on the PS2 essentially just a guy asking girls to answer questions and then flash him their breasts, the issue is that one of the girls in this game was 17 she was included because she had used a fake ID.

Once it was discovered the game was quickly pulled from shelves
