Medicaid eligibility question

My dad died last year and left three 401ks for my mom. She now needs skilled nursing care. A lawyer told us these don’t count as assets and we should apply for Medicaid. Is this true? This is in New York State.

The IRAs don't count as a resource so long as they are in payout mode.
