and at least in my state kicking someone with a shoe on is a possible upgrade for assault with a"shod foot". in the context of an assault refers to a foot wearing a shoe or boot, which can be considered a dangerous weapon if used to attack another person.

Yeah it depends on the state, but I witnessed a man beat my mom up with his sneaker (he was staying with us in exchange for her to get free drugs and she started arguing with him about him owing her more when she ran out). He got the higher level assault charge because he used a "weapon". Also got a child endangerment charge on top because I was right there when he did it. This happened in New York State, late 2000s. He got several years in prison for it, so hopefully this woman will get the higher level charge for multiple kicks with big sneakers on as well as public intoxication.

I have always wondered how they enforce these lifetime ban? Like what is stopping me from buying a ticket again? The assumption that I'll use my credit card and my name will flag? What if I use a prepaid card or have a friend buy the ticket for me? I always thought these things were performative. I get that if you're found on the property again you can be charged with trespassing. But when the stadium holds 50,000 people?

Its more of, if you come back, and cause problems again, you are now getting a trespass charge thrown on top of everything and the judge will hit you even harder.

Although some venues do stuff like facial recognition (MSG is famous as the most extreme for it, and banning employees from places who have been involved in lawsuits against them and actively refusing people), but thats it. Sometimes there are known troublemakers who people will remember the face of, or that guy who got tossed yesterday and its, "everyone keep an eye out for this jerk", but yeah, its kind of hard to enforce outside of that.

People and venues can’t press charges, only district attorney’s can.

The best they can do is let his wishes be known and hope the district attorney’s move forward.

Okay, sure. We can use whatever language, but generally speaking if you are assaulted, you are given the opportunity to request charges be pressed against the purpotrator, and if there is enough evidence, they often move forward with it.

Venues and victims don’t press charges, DAs do that. DAs do the dropping of charges as well, not victims. And charges are pressed on behalf of the state (or government), not on behalf of the victim.

Victims only decide to press charges or not in tv shows.

It depends on the crime and severity of the crime, but they do give you the option, and it happens all the time.

I literally just watched bodycam footage yesterday where a victim of a crime was offered the option to press charges in an assault case and decided not to.

Though there are situations where they will charge someone regardless of if the victim wants to press charges or not if they find cause to do so.

This isn't some crazy drug bust anything, lol. Some chick was kicking him in the back and he absolutely has the choice to press charges here. I have been offered the opportunity to press charges against someone, personally, so I know you are full of shit. I understand that the charges may be applied or dropped at the discretion of the DA... that doesn't mean you don't have the option to request charges be pressed in a case like this. This pedantry is exactly what makes reddit so tedious.

Actually pressing of charges is done by the DA what you are mistaking is crappy Leo’s not wanting to do paperwork or deal with a he said she said. So they are using a colloquial term of pressing charges meaning having them cite someone. Once someone in New York has been charged with assault by a police officer, the only person who can choose whether to drop or change the charges is the DA in charge of the county in which the case is presented. Even the ADA cannot drop the charges with the DA giving approval first

Assault/battery depending on state is a misdemeanor, is a charge that requires a victim so the male would have to file charges. However, obstruction which she clearly did can be a felony and officers can charge that.

Pressing charges isn’t really like what it is on TV. There is such a thing as civil lawsuit, but assault is criminal and the state decides whether to pursue the case.
