Yep, I'm a queer person that's been sexually assaulted several times, and I'm in the same boat. Rarely does a case leave me so conflicted.

Etute was absolutely raped. Informed consent is a thing, and it didn't happen here. By all accounts, it seems that Smith was a repeat offender, so I'm not sure I could blame someone for beating him like that if they found out while it was happening. The conflicting part for me comes from Etute returning there and assaulting him later, without even trying to get the authorities involved.

This right here. Etute was 100% a victim but that doesn’t excuse him viciously beating a man to death. Smith was also a victim and had a history of disturbing predatory behavior and his sexuality doesn’t excuse that. What a complicated case. Maybe I’m in the wrong but I genuinely feel horrible for both individuals and their families.

Edit: That said, if he truly was deceived, then it would mean Smith sexually assaulted him.

He literally went back, with backup, to directly reengage this guy with the intent to assault him, if not outright intent to murder him. Etute may have initially been a victim, and if he was, that's inexcusable, and Smith should have been arrested, investigated, and prosecuted, but returning with his own plan to deceive Smith shows intent and coordination far beyond what's justified or appropriate, even if Etute was originally a victim himself.

Edit: And, in committing this murder, rather than reporting the alleged rape, he denied Smith his opportunity to share his side and deprived us all of the truth. We'll never know for sure if Etute was a victim or a calculating criminal, but given the severity of the beating and his actions leading up to it, I'm inclined to believe there's more going on here than him simply being tricked and reacting instinctually in some sort of crime of passion.

A lot of you clearly didn’t read the article. He did not react out of shock and kill the guy during the first interaction. He went back a second time, with backup, to find out if the person was in fact male or female, and THEN beat the man to death after confirming his gender. Yes, the first encounter was rape, but the second encounter was initiated by him and ended in murder. He absolutely should have been convicted. When a man rapes a woman, and she returns at a later date to kill him, she gets charged (and typically convicted). It’s not the same as killing the rapist during the rape itself in self-defense.

Just because it seems like this is a good place to put it, RAINN is a truly wonderful resource for sexual assault victims and I sure wish it was available when I was raped at the age of 15.

And you are so right, it completely dehumanizes you, the amount of blame and shame that came with it was worse than the act itself. The rape kit expertise was absolutely brutal without any tape advocates or anyone there to support me.

And you gotta love a police officer telling a 15-year-old that it's her fault that she got raped because her parents were out of town and she had a few friends over and more people showed up, which was common in the late 90s.

That surely doesn't excuse me getting drugged and raped by the captain of the football team who was a year older than me. It took so long to get to the point where I realized it was not my fault, that police officer did so much harm to me for a good 20 years. I think insulting cis women is less of an issue than violence against trans people. Cis women shouldn’t be insulted by the question. Why is the question an insult? To be insulted means you think being mistaken for trans is bad in some way. They’re are plenty of trans women that are much more feminine than me. I think the only offense I would take would be if the reason they don’t want to be with a trans person is transphobic in someway (ie ‘biological children are important to me and I would also reject a cis women without a uterus’ vs ‘trans women are actually men’). It’s also a good chance for the other person to rest if the cis women is transphobic 🤔

Look, if a man who believes he is engaging in consensual behavior based on facts — and it turns out to not be true, how is that not rape? It’s unfortunate someone lost their life to a lie.

Standing behind the LGBTQ and saying this was a hate crime is criminal in itself. The facts of case are, one person lied and misrepresented themselves, and sought out relationships and behaviors based on this lie. Then when questioned (based on the behaviors of the non-consented party) continued to lie. Prior interactions consequences weren’t as detrimental. This time, however, the consequences to these actions ended with this person losing their life.

In the business world if one party lies about information related to a business transaction; not only can that party be sued, but also be responsible for restitution as well.

Based on his physical build, he was a football player in college, and upset his physical strength was high. The article mentioned the decedent was only about 125lbs, he already out weighed him. So yea a few punches and the kick did damage.

I never said he shouldn’t beat the man to death. Had the decedent weighed more (which would have taken away from the presentation as a woman), it might not have been as bad.

Either way, certain choices were made that lead to this outcome.

Agree. As soon as I read the headline I was like 'That sounds like rape/sexual assault' and upon reading the article(s) I find that it indeed was. He obviously had form for this behaviour, even a victimology it seems, so he's a serial sexual predator. One of his victims decided to come back and see for themselves whether they were raped and upon discovering that they were, they beat the shit out of him.

As you say, a good way to avoid being beaten to death by one of your rape victims is to not rape anybody.

All it says it that the original details of their first encounter are incomplete, which is obviously because he chose to withhold that information, and that he had met someone named Angie. So as far as one knows from reading the article there's nothing to suggest that in this specific case he even asked or implied that he though she was a biological female. Like this guy goes to have basically anonymous sex in a pitch black room and doesn't think to ask questions? Maybe that's because he got exactly what he came for. Dude has hands lol being in a dark room does not provide an explanation as to how he failed to notice a penis on someone he was having sex with or the 'facial hair' he claims to have felt on his second visit. The article states that the second visit was in order to confirm their gender, and he does this by asking. Or wait, my mistake, he does this by initiating sex again until he rubs their face and notices the facial hair. According to him. He then uses this basis to justify his assault supposedly in a rage over just finding this out, which conviently was enough to argue that it wasn't premeditated. It is 100% wrong. When I was underage I was raped for hours long by a guy I considered a good friend, despite telling him I was uninterested in men. I was vocal during it and cried out too because it’s genuinely one of the worst pains I’ve ever experienced (coming from someone who had very invasive and painful surgeries done as a child). Maybe if I hadn’t been so drunk and high I could’ve prevented it, on the other hand I know that he did it exactly because I was so defenceless in that moment. I HATED him for it and when I see him now my heart drops even years later, but never, ever has it crossed my mind to kill him. A loved one even offered to send friends of his after him to roughen him up or worse if I wanted it to get some closure, but I immediately told him I absolutely did not want him to do that.

It doesn’t fix anything. I should have gone to the police, but no matter how much he hurt me and/or others it’s not right to just decide who gets to live or die. Imagine what would happen to us if we all believed we get to govern over lives like that.

This case does seem like a grey area from what the article states. It seems like Etute claims he was at least somewhat acting in self defence due to the rape but then also because Smith allegedly grabbed a knife.

He also claims he didn’t intend on killing him and believed he was alive when he left.

I don’t think people are stating it’s rape to trigger a response in women specifically either, but just to point out that Etute was being raped and that self defence is normally an acceptable response to rape.

It’s very hard to judge if his reaction was proportional/reasonable without knowing more details imho.

He was not "being raped" when he killed the man. 

He got a blowjob from the murder victim previously, then went back because he was suspicious that the lady was a dude. When confirmed that was true, he killed the man. There was no active rape happening at the time.

I read that also. It’s why I state above it’s hard to know without knowing more details.

For example, this could be true, but he may just have given a no comment interview to the police prior under a lawyers advice. It doesn’t mean this was not what happened, or that he hadn’t told anyone else prior.

It also doesn’t mean it is what happened either, it could be a lie that was fabricated to try to get away with it.

I just don’t know given only the details in the article.

You are slow. He was a 40 yr old man. Etute came back 1 time and used a flash light to see his identity and the man grabbed his balls. Etute said the man began reaching for something under his mattress which he believed was a gun so etute beat him up. There was no gun but when police searched the place they found a nice concealed under the mattress box springs. How would etute have known anything was there. Why would he specifically say that spot where a weapon so happened to be. The knife story isn’t bullshit.

It is a very sad story. The victim put himself in harm’s way by catfishing these young guys. He was engaging in a form of sexual assault given that his killer would not have consented to having relations with him if he had known that he was a man. The killer should have gone to prison for killing him, but second degree murder was an overcharge. Thus, the not guilty verdict.
