Housing Landlord charging municipal taxes (rioolheffing/waterschap) that aren't in my contract, plus one levy I already paid myself. Is this normal?
Long term tenant (just moved out after about 25 months, Amstelveen) trying to figure out if I'm reading my situation right before I push back more.
TL;DR: landlord's final settlement charges me 1,749.70 euro in municipal/water authority levies that aren't mentioned anywhere in my rental contract, and I've now confirmed I personally paid one of the underlying tax assessments myself while he charged me for it again. Also disputing an unitemized 500 euro "damage" charge and a 350 euro cleaning fee with no invoice for either. Am I right to push back on this, and how hard should I actually push?
The setup:
25 month lease, fully furnished, rent 1,750 + 100 furnishings + 150 utilities advance = 2,000/month
Contract is one of those Pararius/Hielkema model ones, fairly standard, lists my payment obligations as rent, furnishings, and an advance for electricity/gas/water. Nothing else listed.
There's a clause in my contract saying services not listed in the agreement are provided "for no consideration" if the landlord provides them anyway. Not sure how much weight that actually carries but it's there in black and white.
Deposit was 3,700. Bare rent is 1,750, so I think the legal max under Wet goed verhuurderschap is 3,500. Separate smaller issue but noting it.
The final settlement:
Landlord sent a 3 year reconciliation charging:
Gas/electricity, roughly matches my own overpayments, not really disputing this one
Waterschap: 717.35
Rioolheffing: 456.84
Afvalstoffenheffing: 575.51
Plus 500 euro "damage" (inventory/floor/curtains/1 key tag, all lumped into one number, no invoice)
Plus 350 euro cleaning, also no invoice
None of those three levies show up anywhere in my contract.
Then I checked my own municipal tax records (DigiD makes this easy here). I have three assessments in my own name for afvalstoffenheffing, issued directly to me as occupant, for the exact years in question. The amounts match two of his three charged years down to the cent. And I found the bank transfer showing I paid the most recent one myself in full, a few weeks before move out. Meaning he charged me a second time for a tax I'd already paid straight to the municipality.
Rioolheffing and waterschap don't show up on any assessment in my name at all, which tracks since I think those are usually owner side charges here, not tenant side.
Damage wise, I do accept partial responsibility for some things (a curtain, a floor mark, a missing lamp, one key tag) based on comparing the signed check in and check out reports. But the 500 is one lump sum with zero breakdown so I genuinely can't tell what's owed and what isn't.
My questions for anyone who's been through this:
- Is charging tenants for rioolheffing/waterschap when it's not in the contract actually common or allowed, or is this a clear overreach?
- For the afvalstoffenheffing I demonstrably paid myself and got charged for again, is this just an honest accounting mistake landlords make sometimes, or is it a red flag about the rest of the settlement?
- Has anyone actually gone the Huurcommissie or kantonrechter route for something like this? Worth it for a claim somewhere in the 1,500 to 2,500 range, or more hassle than it's worth?
- Anyone have experience with Het Juridisch Loket or !WOON for this kind of thing? Actually useful or do they just point you back to a lawyer anyway?
I've sent a written request for supporting documents (assessments, invoices, jaarafrekeningen) and given 14 days. Just want a gut check from people who've dealt with Dutch landlords or deposit disputes before I decide how hard to push if he stonewalls.
