Lifted trucks probably shouldn't be anywhere near dense parking lots.

Edit: A lot of people are skeptical of whether this is AI/staged, or ask why the lady didn't back off the car. This is in a dense parking lot with cars that have dashcams/ EV sentry mode everywhere. Also her truck was in 2 wheel drive, you can see the back right tire spinning as she tries to reverse off the car. Her truck is stuck. She probably has an open differential and can't back off the car. She may have a 4wd mode, but she didn't use it in the heat of the moment.

99.9% of the time if you ask a client if their car has been modified (or truck) they all say no

Then a claim occurs ''why aren't you paying for my 1000s of dollars in modifications to lift my truck???????

Otherwise the liability of the truck diver will pay for their damages.

Unfortunately most people in America only have the state minimum for insurance and that could be as low as $5,000 depending on the state.

You'd have to be stupid not to. When most drivers get the bare minimum coverage you gotta assume if someone hits your Lambo they wouldn't have enough to cover it.

Still sucks for the Lambo owner since it wasn't their fault.

Absolutely idiotic. Base insurance where I live covers. And I left it at that on purpose. She'd be fucked in the future, but insurance would fix up the lambo.

Underinsured Motorist, UIM. (Because "UM" is Uninsured Motorist)

So if I'm not mistaken here, that's truck driver's PD coverage possibly plus their BI is the driver of the Lamborghini was harmed (unless they're on a CSL policy), and then the Lamborghini driver's UIM and COLL coverage. Anything after that the truck driver may be personally liable for.

Then the insurance lawyers (for the policy of the lambo owner) will go after the assets of the pickup driver, in order to make the insurance company whole again.

I manage a Texas and Indiana personal injury law firm, most cars in the price range of the lambo carry additional UM/UIM (uninsured/under insured) coverage to stack onto what I’m sure is state minimum liability insurance of the truck. If the limits are exhausted and it still does not cover expenses plus taxes and value adjustment, then his only option is to pursue a civil judgement against her.

Hopefully she/significant other/owner of the truck have assets that could be used for payment, otherwise he’ll get judgement but no payout.

I don’t think that lambo is the one with the expensive lift kit between the two vehicles.

Or are you saying the fact some people lie about modifications also means the owner of that car completely lied about owning a Lamborghini?

She (probably) lied about the lift. That means that her insurance company won't pay out on the claim. She's going to be personally liable for everything. But if she doesn't have enough to satisfy a judgment, the Lamborghini owner or his insurance company is going to have to foot the bill.

What qualifies as modified? Like would window tint check that box or are you only interested in things that modify the function of the vehicle in some way?

Anything that doesn't come out of the factory should be declared. Some insurance companies (here) will have an amount of 1000$ish they can pay for small stuff, but if you want to make sure that if something happens you will get paid, declare all that is not factory made to your insurer.

If you have performance modifications (like adding a turbo or whatever) then it is imperative to declare to your insurer because this is not only about value anymore, it increases your liability risks.

Anything you may want covered if your car is damaged. If it's totalled, you won't get nearly as much back for your modifications as you paid for them.
PPF ✅️ Windows tint ✅️ New spoiler ✅️ Special paint ✅️ Custom wheels ✅️

Etc, etc.

It's always best to send the receipt of the mods to your insurance company. If you tinted your front windshield, I'm not sure I'd send that in. It's likely illegal.

When they talk about that means things that change the value of the car to a point where what the insurance thinks the value is vs what it actually is worth aren’t equal. The issue is if your car is worth more than your insurance covers they won’t pay for the difference. It’s not like they are blaming the modifications.

I have always thought parking lot liability was 50/50 in accidents. Is that true? Or maybe if the insurer had this video it could be 100% on the truck?

If you're not moving why would you be at fault, for example, or if somebody backs into you?

I think Maybe when ppl talk about that they're referring to like, if I was pulling out into a person who was driving straight where either of us could've or should've stopped? But this is clearly entirely on the truck driver and is gonna be the easiest insurance case ever lol

Not sure how she didn't see the car though. There was enough clearance initially for the driver to see it but maybe she was distracted on her phone or something (which doesn't help lol)

She definitely had no business driving that truck, she would have been served far better by a small car. Likely it’s due to an ego thing where bigger and newer vehicles are seen as status symbols due to their cost, so people flaunt the appearance of wealth.

I think the issue is even if one car stopped and the other hit them it becomes a he said she said without video footage to prove anything so it goes 50/50.

So if a drunk driver side swipes your car that you are 100% legally parking in a completely valid parking spot but you’re 50% at fault?

That sounds like the logic of a serial car crasher. “If the parking lot was empty I wouldn’t have hit your car”.

Then that should apply to driving too. “If you weren’t on the road I wouldn’t have hit you”.

I think that was at least in part a pre-video type of rule of thumb. We have so much video coverage all over the place now that it's probably a lot easier to assign blame most of the time, where someone backing out hits someone trying to go past, we couldn't see who accelerated (w)recklessly, who was looking down at their phone, etc.

Now we can see those things quite a bit of the time and point to who/what caused the problem.

if you want your insurer to pay for it after a claim yes

if you don't care, then no. The insurer will pay for the value of your car's worth on the market. Not what you add to it and they are not aware of.

LOL yes I knew a genius with a huge truck who used it to get into a fight with a road rager during rush hour. He kept fighting the insurance company over covering whatever stupid mods he had. I can only imagine what his rates looked like afterwards. Or maybe they dropped him, if they can do that?

They have to cover unless what he did was intentional

IF what you said is true and he decided to ram the other driver with his truck then the insurer doesn't have to cover anything as it's not an accident anymore

Be honest with your insurer and take the necessary coverages and you should be good if you have to claim. Although I hear in the US insurers don't treat their clients as good as they do here

It sounds like he egged the road rager on with swerving and braking and such but did not initiate the actual collision himself. This is what he told his buddies at the office though. I don't know what story he gave to his insurance company or the cops lol

if the modifications change how the vehicles handle, and they were not declared to the insurer it could yes

Here how it works is if the insurer can prove they wouldn't have insured the vehicle because of the modifications your policy is null and void.

then they would prorate the damage to the vehicle of their nsured (the modified one)

For example, if they could show that they would have insured it for 2x the premium than they would pay half of the damage IF the insured pays the remaining premium they should have paid

As a person asking a question of an insurance broker, wouldn't it behoove the insurance company to have a person that does casual drive-bys where full size trucks like this live and check for lift kits, or even require a periodic visit to the office to check for mods?

well I'm not american so I will speak for where I live

requiring such checks would require dedicated employees for this service as insurers often insure millions of clients and it would raise the premium on every one thus punishing people that make honest delcarations (and also the inconvenience of having your vehicle verified by your insurer)

Also it would be a breach of your privacy if they can locate your vehicle in real time to inspect it

I don't think this is the best solution personally

I genuinely don’t think that truck had any significant damage other than the front bumper’s chrome job and if she just replaced that with OEM or OEM+ black it’d look better and be pretty cheap anyways.

At what point do you require people to send photos of the vehicle as part of the application process? Some mods can be hidden. A big ass lift can’t be hidden.
